Our client was on her way to work as a server in Charlottesville when the defendant T-boned her vehicle at high speed. The damage was so extensive that law enforcement feared that she would die. She suffered a traumatic brain injury, was unconscious when EMS arrived on the scene, and still cannot recall the accident. For a period of time, the hospital workers didn’t know who she was because she was unable to tell them.
She suffered a subarachnoid hemorrhage (a stroke caused by a burst blood vessel in the brain), subdural hemorrhage (bleeding between the brain and the skull), spinal fractures, injuries to her ligaments, and a C1-C4 epidural hemorrhage (a dangerous condition when blood collects in the spinal canal). After a two-week stay in the hospital, she was transferred to a rehabilitation facility to address vestibular and shoulder problems. She has undergone occupational therapy for speech and memory function. She continues to improve but has remaining issues.
Attorney Richard Armstrong took on the case, and his legal assistant Ginger Fitzgerald worked closely with the plaintiff through her traumatic brain injury to work on the case as well. The case was settled via deposition for $1,000,000.
