The plaintiff was driving northbound on Interstate 95 when he was rear-ended by a tow truck. At the time of the accident, the plaintiff was nearly at a complete stop for the traffic ahead.
When struck by the tow truck, the plaintiff’s vehicle was pushed into the vehicle in front of it, then veered off the highway, slamming into a concrete Jersey wall on the side of the road.
The plaintiff was taken to the emergency room by ambulance and received stitches for lacerations to the head. He was also diagnosed with a neck sprain, for which he sought physical therapy for two months.
